So I got tail-swiped last night by a mercedes. Dude managed to flip his car in the process, and walked away. Pisses me off because when I talked to him to make sure he was OK, he sounded drugged, I thought maybe he had a concussion, but the paramedics didn't take him off.. the only thing he said to me was "What a waste of money" looking at his car ( Read more... )

Accidents suck. Cops suck even worse. I've got a little cheatsheet I can give you that tells you what to do and what info to get. Basically get his name, DL#, address, Insurance policy company, policy #, and phone numbers for him and his company.

And no matter what, don't admit blame. Let the insurance companies figure it out.

You may need to claim on your insurance to get it fixed, and then have them go after his insurance. And the police will have a report the insurance company will want.

I kinda want to see pics of his car.

Yeah I do have to admit Mercedes makes a bad ass car when it comes to roll overs. The roof wasn't really even dented despite the weight of the car resting on it, the front windshield did blow out, but other than the spot on his front bumper where he hit me, the car was pretty much intact. A couple pieces were scattered here and there. Unfortunately my camera phone doesn't have a flash, so I couldn't get my own pics.

Just so you know, in the state of Texas a rear end is the fault of the person who hit the car. You should be fine. You need to call you insurance company immediately and file the report. Make sure you let them know he was driving fast and right on your tail and you had to slow down. Don't tell them that you were slowing down to get him off you ass.

Well I did call first thing thismorning, and unfortunately I did tell them I was trying to get him to back off, but my sister JUST completed a defensive driving course and told me that one of the first thing they tell you about tailgaters is to give a courtesy brake-tap. So. We'll find out on Tuesday....
