So me and the bank have been having words the last few months, they say I owe them lots of money and I say that I don't own them anything other than charges which are illegal in scotland kiddies ( Read more... )

The charges haven't officially been termed as "illegal", because the bank have stopped any cases from going to court, meaning there has never been a ruling.

The law says though that the penalty charges must represent the cost to the bank, and they banks are not allowed to profit from the charges. As the cost to the bank is estimated at £2.50 - £4.50, the banks ARE making a profit from them, putting the legality into doubt.

As a result you can claim back your charges for the last 6 years, or 5 years if you are in scotland. You will probably have to take the case to court, but the bank will refund you before the hearing. Even if there was a hearing (which won't happen as the banks won't tell the court their costs, as it would open up a flood of claims), you would win.

Well heres hoping you can get those charges back. They are way over the top anyway even if you go 1p over you get charged loads :( Fair enough a fee for covering the paper work, sending out letters, a little for the hassle etc but it's not nearly as much as they charge!
Take a note of the time of that call, the womans name if you have it and you can use it as a bargaining chip as well. "I was trying to sort things out, I was talking to one of your employees and your bank hung up on me!" Every little thing helps in this sort of thing.

On another note - have you ever been to the Ministry of Burlesqe High Tease nights at the classic grande? They are actually a lot of fun!

no i keep going back to club noir so have never gave the MOB a chance! Is it any good? Are there difference between MOB and club noir?

It's much smaller, more a sort of 1950's club feel. General consensus is that the acts are much better than at Noir. There hasnt seemed to be the whole snobbery thing going on that Club Noir sometimes has. You can get to the bar as well :D

The CA is right, you can claim them back. My dad works for the CA and told me about that a while ago, if i'd had them charge me more than once i'd be claiming them too. My uncle's in the process of doing it now, and a few people he knows have claimed it back as well.

excellent, i was so annoyed when they hung up the phone on me though ahah!

I was voting yesterday and amanda's mum was one of the officials, she was saying that amanda was going to work with some nuns over the next few months! I'd never have had her down for that in high school!

Yeah my mum was speaking to her too, and she mentioned it to me when she came back. Something about working in what used to be or still is, i don't know, the cardinal Winning offices in Glasgow. I never expected that either. I for one still have no clue what i'm going to do.

The very fact they are trying to palm you off with half means they're scared. They know you can get more, but if you took that then you'd be fucked.

I think its been about two weeks now, but they say it should be 14 working days. I'm going to the bank tomorrow to shout at someone for not posting my statements out quick enough though.

The 14 day deadlines are just that, 14 days, rather than 14 working days unless you explicitly stated 14 working days in your letter to the bank ( ... )

I went into my bank and I asked a clerk for my 6 years worth of statements and they agreed in person, so no letters had to be posted. They said it would take "around two weeks" so I'm going to chase this up tomorrow with them (hopefully catching them before the banks shut at noon!)

My main concern is that these charges were the result of a rouge direct debit, one I cancelled but maybe came out anyway? I would be happy to square the bank up for this one off payment but the rest of the charges should not have happened, thats correct right?

How did you get my lj by the way?
