the main problem with punishing intent is that it is completely impossible to prove beyond a reasonable doubt. I agree that the intent is the bigger problem than the crime, but sadly there is nothing that can realistically be done other than admitting lie detectors into evidence.

Punishing crimes is a major issue that I have no clue how best to deal with. I am strongly opposed to the concept of revenge. I don't think it does anyone any good and can do plenty of harm.

It is such a tough issue since our criminal justice system currently fosters crime rather than deterring it, but I don't have any better ways to solve the problem:(

what about attempt? if i shoot at you and i miss, what should my punishment be and why? how should it compare to if i had hit you and killed you?

also, if i shoot at you and kill you, should i be punished differently if i intend to kill you or if i dont think the gun is loaded and i am kidding around? can you prove these situations?
