False. It's the servers table, if the server can see that an item has something on it that its not supposed to have (ie. tomatoes) and still takes it out, then it is just as much the servers fault as the cooks. Or.. the food wasn't yours to begin with.

(Maybe not applying to Olga's, forgot how the kitchen runs there.)
