That's almost funny. His argument is that it opens up the possibility of too many lawsuits. Well, it would only do that if there is a pay imbalance, wouldn't it?
However, he raises a good point. We can't, as a government, afford the number of lawsuits our judges are frequently requested to resolve.
Perhaps we should make unequal pay, rather than a civil matter, a criminal offense? Those in charge of managing pay go to jail for M months for deliberate offense, rather than be fined?
The fact is, though, the lawsuits happen with or without the law there. It won't matter either way. Also, technically people still can't be punished for a crime that wasn't a crime at the time...
I do admit to somewhat taking a different stance on the tying courts up item... civil tortes (the lawsuits) are completely different from criminal proceedings; it's hard to tie up judges who are already there for such proceedings, and I'd rather have more cases go on helping people to gain equality than because some jackass burned their hand with their coffee and were too stupid to realize it might be hot.
