I'm not sure, but I think that since the verdict was overturned is the key here. If he was found not guilty by the jury then he couldn't be retired.

Generally, when you're trying a rape case, you got sperm to prove it beyond the doubt of a terrorized 5 y/o.

Exact;y why I don't support the death penalty. Or crooked judges.

Did this crime happen in the early or mid '90s? There was a trend back about then to find a child molester under every rock. Procedures of evidence and witness that had served us well for so long were thrown out the window and normal court methods were changed to "err on the side of children". Many people were falsely accused of things that didn't even happen. Children were encouraged to rat out people and some falsely accused adults when no crime actually happened. Child sexual abuse was the fashionable explanation for any problem so they went looking for it and saw it where it wasn't.
It was a weird time.
