Robert Downey Jr. + Jude Law + Guy Ritchie = enough star power to make a new character, they dont need to rewrite (yes im aware they are basing it of a shitty comic) one of the most iconic characters of all time.
For crying out loud there is already a perfectly good homage to Sherlock in circulation, note how they didnt have to hang off the coat-tails of the name and still make something uniquely interesting and popular.

From what I can tell, a producer had a unique vision for sherlock.
