The only problem with that argument is that when we give the death penalty only to people who confess, so as to be 100% sure of their guilt, that provides a HUGE disincentive to confess. We need those confessions.
I don't have sympathy for anyone who kills anyone, but we also shouldn't be levying different punishments for more brutal crimes. Murder is murder, whether it's confessed to or not, whether it's brutal or not, and whether it was done in front of children or not. For that reason, it's better to have a foolproof penalty like life rather than to mess around with death for some and not all. And death for all is a much worse idea than any of those options.
