Just went on an awesome run with the rugby team. We went from boyden, up past the bus garage and polymer building, went down thatcher way, UP the van meter hill, down e. pleasant, down the row, down fearing, and then took the bike path by swest back to boyden. I mainly don't like how Kennedy draws parrallels to juveniles and the mentally handicapped. If you want to talk about the cruelty or unusualness of a crime against a certain group you should address that group and that group alone. Especially in this case where the parrallels don't seem to make much sense ( ... )

In regards to paragraph one, the DP isn't considered cruel and unusual by the federal gov't as of now. There no law stating that it is cruel or unusual. So that should be left up to states right...however, yes i know the case vs. minors is different.
Yes, it may be similar with how each state handles them, but to draw parallels between the 2 still blows my mind. It just seems like 2 totally idfferent ideas.
I still think the seriousness of the crime is irrelevant. To steal a line from Justin "murder is murder." thus, capital murder is capital murder. so if someone is charged with capital murder then the case should be heard as such. being 12 and being 16 are 2 totally different things. You have to admit there is a HUGE maturity gap between the 2.
I agree with the last paragraph...it does provide further reasoning for banning it.

All well argued points and i'd expect nothing less from a 2nd year law student ; ). Just wanted to refute due to my position on the issue.

First... You need to hit reply, so I know you said something in response. :P It doesn't get emailed to me if you just hit "post a new comment" :P

Second, you're correct in that the death penalty, as it stands by itself, hasn't been ruled cruel and unusual for a while. But, what I was saying in the first paragraph is that, the Supreme Court is the final arbiter of that and that any challenge to the death penalty would be handled under an 8th Amendment analysis. And whatever the Court decided would apply across the country.

Since they were handling a death penalty case in this instance, they could have gone so far as to rule the entire thing unconstitutional as per the 8th Amendment, but they chose a more narrow holding. Which, I suppose, was the more prudent course of action from a jurisprudence standpoint ( ... )

Haha, seriously. That seems what most law is on issues like this, affirmative action, abortion, etc. Each with good points and good reasoning but they contrast.
And about the parallels, i can def see that. Just lookings at some of the "classic" cases i've done here thru polisci and history it's like "huh? how'd u draw that parallel?" Then you read it and go "O, good reasoning." Just goes to show reasoning is soooooo crucial in law and how you want to adjust the law.
The Law School thing, i am def still considering it. I've contemplated taking some time off before just so i'm sure i wanna drop 300,000 on loans and commit myself to a profession. I think i might take time off cuz i'm such a sporatic person when it comes to my career.

I definitely think taking some time off is a good idea. I love law school, definitely, but... Part of me wishes I had taken time off, saved some money... Maybe gotten my masters first...

But, regardless, if you're ever interested in coming and sitting in on classes, let me know. You're more than welcome.

I can't believe that I missed the first post, and therefore this entire debate. I would have loved to be involved, but I'm not gonna jump in now. You guys both did great, and I enjoyed reading it.

George, MVP baseball is ruining my life. I've only had it since Friday (I bought a Gamecube so I could get it, I'm really not a video game person), and I'm obsessed. I just got a memory card yesterday, so I'm gonna get the season going. I'll probably fail out of school because of this......

Haha...i've played like 62 games already and i can't wait to hit the all-star break so i can see who gets the nod.
As for failing out of school...don't worry my friend, MVP has taken over my life but i still got an A- on a paper and an 88.5 on an exam, still managed to get all my readings and other assignments in.
Just have to put MVP into your "schedule." Maybe i can send u an old NSP time scheduling grid for it? haha
