Xander's not going to jail or any other kind of facility. The judge said that the state didn't have enough hard evidence or whatever to send him to the program that they wanted her to. If she had ruled in that favor, he'd be gone for around a year and a half. The state (the 'victim's' side) said he wasn't safe to be part of the community and crap,
