It's kind of like both?
It's a thin PVC so it bends but it maintains its shape and form.

I pre-ordered and bought it brand new from an official retail store in my home town when it very first came out. It came in an official Play Arts box and there is a copyright to Disney on the bottom of his left foot.
I have to say, I don't really appreciate you accusing it of being a fake.
