Yeah, he's my guess as well. He may be an idiot, but he seems to be rather skilled at getting pass wards - he did manage to break into Hogwarts after all, in spite of all the extra protection we now have. Plus, everybody with half a brain should have realized by now that that potion is nearly useless.

That's TERRIBLE. Students should know that memory potions will NOT help one pass exams if one doesn't have good study habits throughout the course of the year!

Well, I don't think this is the work of a student. With all the charms that have been set to protect the hospital supplies, it has to be the work of someone skilled at breaking wards, and I don't know that many students who know how to do this. At least not this way.
