Does he have a behavioral plan? If he does, is it being followed?

Continue to document.

Collaborate with his other general education teachers to get feedback directly from them in regards to his behavior in their classes.

Never, ever speculate upon whether he is "medicated" or "unmedicated." You are not his doctor and his medical needs are not yours to comment upon. I've seen dozens of teachers get their asses handed to them when they presumed upon this.

All that being said, have you tried to develop a personal relationship with this student. If his behavior is truly out of his control, it may be his ADHD and he most likely feels badly about not being able to focus.

I would take him aside in private and ask him what he wants out of your class and how you can help him do a better job without disrupting the class. If he's just rude and obnoxious, there are other issues in place that has nothing to do with his IEP. He may have an Emotional Disorder.

We're actually trying to get him screened under ED.

The interpretation about the ADHD was the vice principal's assessment.

Administrative should know better than to comment on a child's medical status. Good luck to you and your student.

We're actually trying to get him a BIP. Wheels are in motion apparently.

I've tried positive reinforcement and I think part of him likes it, but he also has a dismissive view of school which has been hard to overcome.

I feel so frustrated because I feel like other teachers aren't really doing what they need to do and I'm bearing the brunt of it.
