Orson Scott Card has said some pretty bonkers (and sometimes objectionably so) things over the years, but I'm inclined to agree with him on this point. Although the Nancy Stouffer plagiarism dispute which he mentions at one point was largely without merit (to the point where it looked fraudulent in some places, I believe).

Yep, a quick look see implies that Ms Stouffer made up a whole bunch of stuff while preparing her court case to make it look more plausible.

OSC is full of shit. Assuming no settlement, the judge will decide whether or not the lexicon contains sufficient original creative work to justify fair use of Rowling's intellectual property, and possibly also whether some of the use was authorised by Rowling and/or Warner ( ... )
