I kind of disagree; libel can be serious. Your blog might be your diary, but I think it has to be considered a publication because other people can read it and be influenced by the things in it. Personal blogs, though, tend to say things that are true or opinion, and neither of those are considered libel.
The thing about a libel suit is that the plaintiff has to prove harm, and if someone's saying things in eir blog that causes actual harm, I think it's important for there to be a penalty for that.
No, libel is definitely serious. I just don't know that my personal blog should be considered as such. I know I definitely don't say anything influential. If someone sees it that way, I'd love to know, because a lot of it is just venting and the like.
If your blog is MEANT for mass consumption and you're posting things that are intentionally harmful to society, or to a specific group or person, yes. I agree, there should definitely be penalties.
You have given my something to consider. I may not necessarily agree wholeheartedly, but it is definitely being considered.
I'm writing a giant trial brief that I'm going to have to do an oral argument about this topic. Some fictional paralegal gets fired for content on his blog. We also did an earlier project about a harmful employment recommendation from a principal to another school's principal about a coach/teacher
( ... )
Well, then its a good thing that when my facebook status mentions work, it simply says that's where I'll be. LOL. My boss is on my FB so I can't really say anything. LOL.
I enjoyed hearing about the "case" you're working on. I was in Mock Trial in high school and loved it...until it got disbanned because no one realized there was actual work involved.
Definitely better to be safe than sorry with fb statuses. My Mom and all these random cousins and such are on there now so I'm pretty tame on there.
I'm all nervous about this oral argument! It's gonna be with a real judge and another student as opposing counsel and our teacher watching and I just don't feel prepared at all. They're like "here figure it out" instead of demonstrating anything to us at all about how to actually construct this argument or say it well. Law school is kind of like that all over though. "Here do something you've never done before, do a good job, and just suck it if you can't figure it out"
