I don't even know what to say. Hopefully they do have your files backed up and either messed up on where they stored them or forgot to transfer them over or something.

You had better get your money back. I, personally, think they should also give you a partial refund for not doing what they said they were going to do in the first place regardless of what happens. That's probably a bit too much to hope for, but geesh. :\
