The whole blood-protection excuse gets worse and worse the more you examine it. Okay, so as long as Harry returns there once a year and calls it home, he is protected from Voldemort.

So he could have spent summers with a carefully-chosen, kind wizard family all along, yes? That would still meet the criteria. Or he could have gone to Muggle boarding school and returned to the Dursleys only during summers. Or a number of other possibilities which would take him somewhere else for at least part of the year before he turned 11. If Dumbledore thought how the Dursleys treated Harry was bad--and he must have known something, with Mrs. Figg stationed nearby to report on his condition (but with no way of actually alerting anyone in an emergency, mind)--he could have done something without voiding the charm.
