They can't. This guy is acting well outside the law--in 1967 the Supreme Court made this guy's actions illegal. Hopefully this guy will get in trouble...

Uh-huh. That's a big fat FAIL on identifying what constitutes racism, pal. Also, makes you wonder what his parties are like.

At least this guy is very clearly violating the law, and is going to get in trouble (I hope). He's an employee of the state, not a private organization, so he cannot deny people just because of something that he believes.
