Not quite true. There's talk of something called the Specter Bill. Here's what I got from the ACLU about it (empahsis on the first part, about being able to be deported if an officer "thinks" you're foreign):

Provisions of the Specter immigration bill that violate fundamental civil liberties include:

* Allowing low-level immigration officers to mandatorily detain and deport anyone -- without a hearing or review by an immigration judge -- found within 100 miles of the border if the immigration officer thinks he or she is an undocumented migrant.

This violates the fundamental right of due process, and will undoubtedly result in the illegal deportation of U.S. citizens and legal residents who appear or sound foreign, as well as legitimate asylum seekers who will face harsh treatment and even death once returned to the countries they have escaped. * The indefinite detention of undocumented migrants who cannot be returned to their countries of origin, such as Iran and Cuba, because the United States has no diplomatic ( ... )
