When Dan and I bought our townhouse last year, we got a signed and sealed copy of our property survey. On the survey from our city courthouse, we have a drainage easement that comes 25 feet into our backyard, and a utility easement that reaches 10 feet into our front yard ( Read more... )

Actually, that's probably not even the first question I need to ask. But I am curious what/if any easements your title work showed.

Title insurance..I had to go pull our paperwork, but sure enough, on the settlement statement that we signed at closing, there was a title record research done, and a payment made for title insurance. I'm assuming that's what you mean.

The property survey that we got at closing verified what the title work showed.

Did you have an Owner's Policy done? I'm just curious if there is anything special under the Standard/Special Exceptions relating to the easements.

I don't know the specific laws where you are, but I could probably easily find out. Personally, I'd see what the Utility Company is willing to do first. Even if there is an easement there, I wouldn't think that would give them the right to come in and make the yard look like they did. You don't happen to have a copy of the specific recorded easement, do you? Any idea if your county records are online? I could find out the information much easier that way.

Yeah, ask Jaime, She might know. I know I wouldn't have the first clue.

Make damn sure they're going to replace your fence and reseed your lawn though.
