It goes to show how convoluted the second season was because I'm not 100% sure either. But I really don't think he had a name or he was caught. It was all part of the storyline with how Aaron was able to "frame" Duncan for Lilly's murder. Remember that Aaron's story on the stand is that Lilly took the tapes and his Oscar from his house that day, and he confronted her by her pool. He said she threw an ashtray at him and then Duncan came home and confronted her about Aaron, and was flipping out while Aaron left ( ... )

annie's got it, as far as I know. Cliff had a key to some storage space or some such thing where Aaron was keeping his Oscar, so presumably Aaron's cell mate stole the briefcase to get the key, and then snag the Oscar so it could be planted on the Kane Estate as evidence against Duncan. Cell Mate Guy never had a name.

None of this explains, however, the fact that Lilly's blood was also supposedly on the Oscar, along with Duncan's hair. It's already far-fetched that they could get Duncan's hair from the hotel bathroom (does the staff there not clean?) but where would they get blood from a girl who has been dead for more than two years?

And the most baffling thing of all is the fact that we were supposed to make any of these connections.

I would guess that Duncan probably had to give samples as a potential suspect early on, since he found Lilly's body. The blood and the hair were on Aaron's Oscar, which was buried on the Kane estate (presumably by Kendall) to make investigators think Duncan or his parents tried to hide the evidence. So if it was buried, I can see remnants of hair and blood remaining. But wouldn't forensics be able to tell the difference between dirt that was undisturbed for more than two years and dirt that was recently dug up and patted back down?

Yeah, plot holes you could drive a truck though.
