I'm pretty sure you're still responsible. I'm almost positive. The insurance company will argue that you should have been paying attention and looking behind you. And since you hit him... Have you reported this to your insurance? I know you probably may not want to, but if this happens to him a lot, I have to wonder why. Why would a person park their car in a place they know is dangerous? :/

i didn't report it to insurance because i was hoping it might be less than my deductable and i could just pay him out of my own pocket without having my insurance shoot up. would reporting it to my insurance and explaining the situation help with getting it covered? ahh, i have no clue when it comes to these things.

call the police and or your insurance company.
a similar thing happened to me, i was in a store and someone hit my car, and they claimed i was illegally parked, but i wasn't so i got $$$$$$$ :D

there is no way i'd give some guy $800 without asking every person i could. when you hit him, was he there? or did you leave a note?

he wasn't there. i left a note and he called back when he got off work around 5:30. at the end of the conversation he apologized, "for all this" and of course i was like, "umm, it's ok..." (because i hit him, but then i was like, "was it in a parking space?" and he was like, "no, i was just running in quickly for something..." but see, he wasn't really because i hit him around two and when he called at 5:30 he said he was just getting off work.

i mean...no! dont do that.....but if someone parks in a illegal spot in my opnion they should realise its probably illegal for a reason, therefore you should not pay him at all because he is stupid and stupid people will only try to steal all of your money, so they can become stupid and rich like jessica simpson.
