Prop 8 passing was a joke, and I doubt this fight is done with anytime soon.
On this issue though, I HIGHLY doubt they were arrested and had force used upon them in that manner unless they did something that merited it. From that post, the comments, and everything else I'm reading, there is something else he's not telling us. Whether it was because they were on private property and refused to move, or maybe took a physical action on someone heckling them. In any case, he seems to be leaving out a LOT of details and making this into a black and white case (even though such a thing never exists).
...then again, this is the L.A.P.D. we're talking about, so I could be wrong.
I shall echo Vlad. We can't really make a judgment on what happened until they tell us the events leading up to their arrest. We don't have this information because these guys are SMART.
NEVER EVER EVER EVER talk to the cops without a lawyer. That guy Mark is pretty smart in this regard. In his write-up, he didn't say anything about what happened and once they charged him with battery on an officer, he shut up real good. He wrote that the officers were trying to make small talk with them. That's a police tactic to get incriminating evidence against you. They have sound recorders going all the time in police cruisers.
It's not too cool that they weren't read their Miranda rights until 25 minutes after the fact but it probably won't get their case thrown out. Once again though, more than likely both sides did something wrong. Definitely wouldn't want to be one of these guys right now.
