There is actually a technical answer to this that makes it a cake. A cake goes hard when its past its date, a biscuit goes soft.

Apparently a Jaffa cakes goes hard. I've never tried it though, they usually don't last that long around me ;o)

Back in 1991, we fought a battle with the VAT man to prove that Jaffa Cakes are cakes, not biscuits, and therefore should not attract VAT.
