I find it disturbingly ironic that the Occupy UC Berkeley protest was violently put down by UC Police last week in the location the university eventually dedicated to Mario Savio for his speech on that spot in 1964 advocating civil disobedience in support of the free speech movement. That's a bit ridiculous. If they were told to clear the park, they're (unfortunately!) doing their job.

Who gave the order, however, should probably be put to trial for it.

No, I disagree. There is no reason to beat someone with a club for "failure to obey a lawful order" because by this point they hadn't even gotten to "resisting arrest". This was completely unnecessary force.

If the police had previously told the protesters to clear the area, and had a legitimate (law-backed) authority to do so, what's the next step, then?

I'm a bit cynical about the whole OWS movement in general: I don't know if it's a feeling of "too little, too late" or just that when the snow falls, protesters will pull up stakes and disappear. My overall feeling is that it's nice to see the press, but in the long view, it won't be worth much of anything. I doubt it'll be even so much as a footnote in the history books ten years from now.

The Occupy Pittsburgh folks had 1"+ of snow around Halloween, and didn't budge. A local group showed them how to make insulated temporary structures (hexayurts), so they're probably in it for awhile.

That said, sounds like the NYC protest is coming to a head, today?
