I love you bb, but honestly the retard is right. Point to the part of the constitution, or any amendments thereto that support the legislation banning behavior as trivial as smoking in public. Supporting the legislation with "But it's an unpopular/unhealthy behavior!" unfortunately opens the door to fat laws. You're not allowed to eat more than 120% of the calories required for your physical activity. I don't want to see fat people on the street, and being fat is unhealthy. Or laws prohibiting companies from manufacturing certain products because they contribute to obesity and therefore diabetes and heart disease, and are a burden on the healthcare system. As a counter to the "but it affects others!" argument, what about anti-abortion laws? Are they okay because they protect the child? Let's suspend disbelief and state that the child is sentient at the single cell state. Does that make the law more valid? It's still a question of the state telling you what you can and cannot do with your body

Smoking isn't a personal choice that just affects other people, so comparing smoking laws to theoretical fat laws is out of place. Smoking can *kill* other people. I've violently allergic to smoke - even just smelling smoke on someone else who isn't actively smoking sends me running for my inhaler.
I am very much for the new healthy airspace laws, because I'm tired of trying to go shopping and ending up home sick for the rest of the weekend, or being stuck calling off because some asshat decides to hover by the door and blow smoke around.
Smoking should be outlawed, but we both know that won't happen.
As far as refining ingredients, there is legislation all ready in place to put the FDA in charge of regulating and controlling tobacco products and cigarettes. I will be glad when it goes into effect, because it will reduce a lot of the toxins that trigger allergic reactions.
