hey zach..i was reviewing my lecture notesand under marbury vs madison it says judicial review was by congress because they didn't have supreme courts yet or something? idk..it was in my notes.. so i guess that one question was right.
I'm to lazy to look, but the way I understand it is that the Constitution had nothing in it about judicial review. Marbury v Madison established the rights of the judiciary to 'review' the constitutionality of the laws, but only if they were brought before the supreme court in an actual court case (they can't randomly pick a law and say its unconstitutional) I'll look at it tomorrow maybe, but I'm swamped right now
