Frank is 17, he's 18 in 5 months.

The New Jersey state law for consentual sex is 16, however, the fact that Frank can legally consent to sleeping with Gerard doesn't apply because Gerard has authority over him, hence he is his couselor.

The reason for this is prevent sexual manipulation of young people by adults. Eg; in the laws eyes, Frank could be made to feel like he has to sleep with Gerard, or else Gerard could make his life difficult.

Hope that makes sense.
