Okay guys, I'm coming here looking for some advice on a situation I had found myself today. Without any fluff, I'm going straight into it
( Read more... )
That's totally shady. DON'T GIVE HIM ANYTHING. If he does actually post on artists beware, just provide your side of the story. That's really all you need to do. There isn't much "tarnishing" he can do if you have ample proof you provided your end of the bargain on time.
The bottom line here is that you told him you shipped it and he waited 6 months to say anything to you about it not arriving. Like you said, if he had said something sooner you could've helped him. But 6 months later? Shit outa luck.
If it was me and I had the evidence that you have in my hands, I would not give into him. While he claims it is your responsibility to keep track of a shipped piece, it is also his responsibilty to follow up on it if said pieces do not arrive.
In this case both parties are guilty. Me, personally? I would have delivery comped it. My days from Ebay got me on to doing that given I had similar disputes over such things happening.
To protect yourself I would ensure all have DC (delivery confirmation) from here on out. Charge extra to the user for such or they can decline it, in which case they are fully aware of the consequences of such.
Additionally, if you have the receipt for the shipment, I would show that too in this matter. To show you did ship such. I always keep receipts for a 8-12 months for that very reason.
First, I'd request he show you proof of the missing emails, in return, scan that shipping slip. I know it's not much, but having proof on your end too, can really help chill over attitudes. I mean...it's sad, but there are artists that will simply go 'I shipped it, tough shit!', and never show any proof beyond their word. Maybe he's going on the extreme defensive due to thinking he's being ripped off on his end?
Once you get that to that point, see how things unfold. Hopefully some more evidence on both sides can ease this into a more mutual fix from here.
