What's too bad is that there are arguments he could have made - he just hadn't thought anything through. For example, he could have said "Terrorists kill people. All freedom is dependent on being alive. Thus, terrorists significantly reduce freedom, and stopping them therefore prevents this reduction."
This obviously assumes that the Patriot Act deters terrorists to such an extent as to overwhelm the freedoms lost, but a Bush supporter would probably assert that this is the case.
Hopefully you won't have to drink the Hemlock anytime soon.
