So, today the CA state supreme court is hearing the case to invalidate Prop 8 which took away the rights given gay couples to marry in CA. Prop 8 won by a narrow margin this past November

The problem is that there are two institutions. There is a secular social union and a religious union. Unfortunately they have been lumped together into one term called marriage. The state has no right to tell religious institutions who should be allowed to be married in their faith. Conversely, people should not be discriminated against simply some religions say what they are doing is wrong.
A lot of the problem seems to come around the word "marriage" itself; it's an institution created by G-d, and defined specifically in the bible. My response to that is the word is actually קדושין (kidushin - to sanctify in Hebrew) and therefore the word marriage should not be specifically reserved for religious marriage.
