Well, now that the FDA can officially regulate based on flavor, they are moving on to alcohol too.

I was chatting with a smoker at the bus stop who was apparently totally unaware of the ban (until I was through with him, that is). Furthermore, he could not believe it! In the mid '90s, the FDA took it upon themselves to regulate tobacco. In March 2000, a 5:4 Supreme Court ruling ended that. In the ruling, delivered by Justice Sandra Day O'Connor, it was noted that compliant with the Food, Drug, and Cosmetic Act (FDCA), if the tobacco were to fall under the jurisdiction of FDA, FDA would be obliged to ban it ( Read more... )

A ban on clove cigarettes was declared unconstitutional in Florida in 1985, although on a technicality: the law covered two separate subjects which was in contradiction to the state constitution.

(However, one unfortunate fellow was still mistakenly arrested and fined for possession of clove cigarettes 18 years later.)

While it is clear that the bill was opposed to by a majority of republicans and a few conservative democrats, it does not follow that this issue should be decided on the basis of partisan politics. 20 years ago Nevada repealed the ban on the clove cigarettes that had been in effect for four years. This shows that, although laws and bans are difficult to repeal, it is nevertheless possible. But since this story happened before the internet age, not much information is available ( Read more... )
