basically, whether you have to pay a deductible will come down to whose fault the accident was. Most of the time, when you're rear-ended, the other party's insurance company must pay for 100% of the damages, which means that the deductible on your insurance would be completely moot.

In rear endings, its automatically assumed that the drive behind is at fault. As long as you have their information and the police report, they (or their insurance) should be paying for it. Good luck in wading the horrible world of insurance. :/

My experience is that you should never listen to what the other person's insurance company says. Only listen to yours. Go to yours with anything the other company says to you.
