Responder gets 100% blame. If he was going to invite then he should have used 2h...3s. When youre playing the 2c...2s sequence you mentioned, that invite is looking for a max in HCP and the transfer-raise sequence is a shapely invite looking for good fit and controls.

So, systemically, 1N - 2C - 2R - 2S is the only way to invite with spades... 1N - 2H - 2S - 3S is forcing, looking for cuebids.

2) Definitely pass. I'm excited to pass. It's my immediate decision (but don't worry, I'll be good about putting the pass card down at the right speed for UI reasons or what not). To me, the question is more what's partner's hand and could they really not have stretched for a reopen, than should I have done something else.

I think pass is 100%, but there were a few good players at the tournament that were shocked that I didn't pull out 3H. Nice to have a little validation....
