Are you saying that if I am in two identical accidents except that in one case I collide with a bike and in the other with a car, and the biker is inevitably more seriously injured, that *I* should be more harshly punished in the bike case? Shouldn't the consequences I face be simply a function of my own behaviors rather than whether or not the other driver decides to use a motorcycle or a car?

Are *you* saying that if I kill someone while driving my car, that the punishment should be based on their choice of transportation?

Where is that line drawn? If you're driving a bus, and I'm on a bicycle, is it MY fault that you made a poor judgment call? What if I'm walking? What if it's a small child, who *did* look both ways, and saw a stopped bus at the time that she began crossing the street?

(Additionally, the biker isn't "inevitably" more seriously injured. There are way too many variables to account for, and when you're dealing with a lighter system of bike + rider in which the rider can (and often is) separated from the mass of the bike, there's a reason that motorcyclists tend to wear protective equipment, and in fact are required to in Edmonton.)
