Notifying Landlord About NOT Resigning A Lease (Drama)

I just got back from my apartment's management office, because I needed to notify them that I will not be renewing my lease at the end of the month. My lease is up November 30, but we are moving this weekend (Nov. 10). Did they send you a renewal notice? Every apartment I have lived in has sent me a letter approximately 60 days before the end of the lease. The letter contains a new signature page for the lease and info regarding changes. It also contains a short form to file if you are not resewing your lease. If the form is not returned in a specified period of time, it is assumed you are continuing the lease. Therefore. you are required to give a standard thirty days notice before vacating.

Google NY renter's rights and see if you can find anything. If you did not get a renewal notice, you might have some ground to stand on. I know laws in
PA CO and IL but not NY. Good Luck

The only notice I received, in early October, said "Come see Natalie about renewing your lease." There was no signature page or info about changes or non-renewal forms. Even today when I went down to discuss leaving, the only form I filled out was my contact info and forwarding address. I'm taking my lease down to the office tomorrow and asking them to show me the part about notices directly.

Wow, that's messed up.

My place does the cool thing where if you don't tell them you're staying, they'll just rent it out to someone else. Thankfully they're nice and send notices about the reminder deadline beforehand. The bad thing though is that this deadline is FOUR WHOLE MONTHS before the lease is up. I shouldn't have to explain why that sucks. :p

Yeah, I really don't need this to worry about right now. And do you mean that YOU have to give four months notice or they do?

I have to give four months notice if I'm staying, or they will assume I'm leaving and rent it out. If I'm leaving I don't have to say anything to them, although I'm sure they would appreciate it if I did. It's kind of exploiting a loophole that landlords can choose not to renew a lease with someone for I believe any reason provided they give proper notice.

I can see why they do it, as they primarily rent to students (their leases actually go from September to August) and have been burned probably one too many times by a student that takes off over the summer and they don't know if they're coming back or not. It still sucks for people like me though who don't follow a university schedule and could potentially leave at any time (they're not willing to ever go month to month).

Student housing I can kinda understand the four months notice rule, but that's still a huge amount of time. Another argument I have here is that it's SO hard to find an apartment in the city -- what happens if you're looking for a new place right up until the time your lease ends? Then you have all the new apartment costs AND you lose the deposit.

Indeed she is! I watched an awesome case the other day where a woman was suing another woman who sold her two phones on eBay and (apparently because the auction was worded cleverly) sent her a picture of the phones. Needless to say Judge Judy pwned that scammer. ;)

Yup, but I'm actually loving the People's judge better... When she gets fed up she starts telling off the person in Spanish (well, Cuban-Latino). In one case where a step-mother was suing son for money loaned, she actually told them she was surprised they remembered to breathe... He needed the money to complete an eBay sale with a guy from Nigeria... Neither of them knew or cared where Nigeria was or that if you sell an item, the buyer should send you money.

Ugh, I ran into that problem with my first apartment too because my roommates and I both made the same assumption. I think we somehow got out of it though. It was over 17 years ago, so my memory is kind of blurry on that one.

I am NOT a happy camper. I've read my lease twice, and it says nothing about giving notice, and a lawyer in newyorkers says that unless my lease has an "automatic renewal," I do not need to give notice. I really hate fighting about stuff like this, but goddamn that's a lot of money.
