need legal help

Pyramid Print refuses to give me my last pay check. They "claim" it was mailed to my old address even though they had the new address that I've been living at for the last EIGHT months! Now, they tell me that I'll have to pay to cancel the other check and then they can reissue me a new check ( Read more... )

I believe that by law your former employer has either 48 or 72 hours to get that last check to you. Do you have proof of when you gave them your new address? You might want to contact the Labor Department and see if they can give you more specifics.

One final tip: when you do finally get that last check, take it to the bank it is written on and cash it there even if they charge a fee for it. I did not do that when I got my last check and it bounced, causing me a lot of headaches to get our account current again, plus having to go back to my ex-employer and get a new check.

thanks for the advice. After I mentioned getting a lawyer to Tom, I get a phone call the next day from his accountant informing me that they will write me a new check but that they will deduct $32 for having the other check cancelled. UGH! Should I just take my losses or actually get legal counsel? This is very annoying!

On a positive note, I really like the new job. I get complemented all the time. :D

I picked up my check -$32.00 and $5.00 to get the check cashed, went to the issuing bank, and cashed it. The guy was so mean to me. A COMPLETE ASS! I'll probably have to fight to get my W2 come next year. Thanks for your advice.

My mail still gets sent to the wrong location all the time, but then again considering how small the town is.

I quit this job. Gave my one week notice as requested. During that last week, he only allowed me to work maybe 25 hours including one day I drove all the way to work, and he told me to go home because there was no work to do. I contemplated not even finishing the week because my new job had work for me, but I didn't want to have a BAD reference. Guess that didn't matter much considering the way I'm being treated now.
