I just read the court judgment in EMI v. Promise Media from 13th August. I'm very, very pleased because finally a court in the US has ruled that unlicensed sampling can be protected as fair use. Of course, this is still state-based rather than federal, but it's nice to see that the Supreme Court of New York has managed to reach a sensible verdict, ( Read more... )

Have you got a link to a copy or a summary? This happened whilst I was on holiday and I missed it.

Something similar is going to be enacted in European Law soon....need to get up to speed!

Did you see the UK verdict on the unlicensed downloading of a Game in the UK last week? Bad news in the opposire direction to your good news, or at least it will be once the record companies start to use the precedent. They wont have to bother selling music anymore....

Yep, of course - here's the link to the report. It's funny, because Lennon's family and EMI already unsuccessfully tried this before a Manhattan federal court, I don't know what possessed them to try again.

There was also this fair use decision in the Lenz v. Universal case recently.

I didn't see the UK verdict, do you have a link to it?
