Well... is the apartment multiple rooms? If it keeps happening, you could let him know that you work early and go to bed at 'X' time and ask that he keep things quiet just above that room where you're sleeping? I've had good luck with that when I worked night shift.

Most people aren't jerks, just self absorbed.
