Okay the European Court and most humanitarian groups wish that voting becomes a basic human right and one that cannot be removed by being a person being labelled a criminal or a prisoner

Arguments for: 2) you could be in prison for a month for a trivial offence, and miss the opportunity to vote, while someone else is in prison for 4 years and doesn't. 3) you might be in prison for something not universally accepted as an offence (e.g. drug taking, or file sharing) and miss out on the opportunity to vote for someone who supports your cause.
I've seen some people suggest that if you're in the final 5 years of your sentence, then you should still be able to vote, covering case 2 (this would tend to exclude people guilty of violent crimes or other major crimes). Of course, if the music industry has its way, then file sharing...
