I think the mind determines it more than anything. What separates people from beasts is just...the difference between reasoning and pure instinct. Of course, the line can be blurred.

Some are labelled beasts simply because they think differently. One doesn't need to be a human to be a person.

...Language seems to be the obvious indicator, but I don't think it's universal. Understanding is a bit more subtle, but probably more important.
